§ 1 General provisions

Academic Works LLP is a limited liability partnership registered under the laws of England and Wales with company number OC443692 (the “company”, “we”, “us” or “our”). Our registered address is at 411 Oxford Street, London, W1C 2PE, United Kingdom (hereinafter referred to as the “Contractor”), declares that these Regulations define the rules for concluding and performing contracts between the Contractor and the client Contractors (hereinafter referred to as the “Ordering Party”).

These Regulations also define the general terms, conditions and method of providing Services by electronic means via the Contractor’s website available at: akademickeprace.cz (hereinafter referred to as the “Website”).

The subject of the Contractor’s activity are editorial and editorial services in various fields of science as well as information and advisory services. The Contractor provides services in the field of writing scientific studies, constituting only a model or a starting point for writing own works by the Ordering Party. All works written by the Contractor may be used for information purposes only and in a manner that does not infringe the provisions of the copyright law and the 1988 Copyright, Designs and Patents Act.

All teaching materials, analyzes, scientific studies or any other texts are made at the individual request of the Ordering Party, in accordance with the provided requirements and guidelines. The Contractor declares that the prepared materials are not subject to further resale and are only at the disposal of the Ordering Party.

Unless the Regulations provide for the form of making statements and communication between the parties, communication via e-mail is accepted.

Ordering the service by the Ordering Party is tantamount to accepting these Regulations in full. The refusal to accept these Regulations shall result in the refusal to conclude a contract with the Ordering Party.

The information contained on the Website does not constitute an offer within the meaning of the Civil Code.

All orders are carried out mostly in Spanish and English.

§ 2 Order fulfillment

The ordering party may place an order in several ways:

a) by sending an e-mail to the following address: info@akademickeprace.cz

b) by filling in the contact form available on the website: akademickeprace.cz

c) by calling the following telephone number: +34 919 93 05 17.

The order completion date as well as the form and date of payment are agreed individually between the Contractor and the Ordering Party.

The order completion date agreed by the parties is the forecast date. The order fulfillment period may be extended in the event of reasons beyond the control of the Contractor. The Contractor shall notify the Ordering Party about the extension of the order completion date.

The material is made on the basis of available (also indicated by the Ordering Party) book materials and internet resources.

The order is processed as follows:

The contracting authority places an order through one of the three channels specified in point 1 of this paragraph. In the order, the Ordering Party shall indicate the guidelines regarding the order.

Within 48 hours of sending the order, the Contractor verifies the possibility of performing the ordered service and informs the Principal about it by sending him the Order Confirmation – constituting Appendix No. 1 to the Regulations. The order confirmation contains essential elements of the contract, including the subject of the service, the date of the service, the cost of the service, the method of payment, as well as the Ordering Party’s guidelines on how to perform the contract, provided that the Ordering Party has provided such guidelines in the order.

Within 24 hours of receiving the Order Confirmation from the Contractor, the Ordering Party should accept its content by e-mail. Accepting the Order Confirmation is tantamount to accepting these Regulations.

After accepting the Order Confirmation, the Ordering Party shall pay the remuneration or its first tranche – in accordance with the arrangements indicated in the Order Confirmation. The contract is concluded between the parties on the day of payment.

After receiving the remuneration or its first tranche, the Contractor starts the service. The Ordering Party acknowledges that in the event of delay in payment within the agreed deadline, the order completion date indicated in the Order Confirmation will be postponed.

If the service is carried out in stages, the next stage of service implementation follows with each subsequent stage of payment. After receiving 1 (first) part of the work, the Contractor shall make corrections according to the Employer’s requirements.

If the service is provided once, the Contractor sends the Ordering Party the entire study.

The contracting authority is obliged to indicate the procurement guidelines in detail. Failure to comply with this formality means that the complaints regarding the order will not be processed.

The Contractor reserves that only the guidelines indicated in the Order Confirmation are binding on the Contractor. The contracting authority has the right to free of charge corrections if the guidelines are not met.

§ 3 Rules for the use of scientific materials

The materials prepared and made available by the Contractor may only be an inspiration for creating independent studies, because they are only exemplary and auxiliary.

The Ordering Party declares that it will use it only in accordance with the law in force in the United Kingdom or any other countries where it is supposed to be used.

Studies prepared by the Contractor or fragments of these studies may not be presented by the Employer at universities as their own, as it is an illegal activity. The Contractor does not consent to the Ordering Party’s presentation of the prepared studies to third parties, universities and institutions as the Ordering Party’s own works.

In the event of a breach by the Ordering Party of the provisions of these Regulations and allegations of illegal use of the published studies, the Contractor reserves the right to immediately terminate the cooperation with the Ordering Party, without the obligation to return the remuneration paid so far.

The contractor is not responsible for the improper or unlawful use of the materials provided.

§ 4 Rights and obligations of the Contractor and the Ordering Party

The contracting authority is obliged to pay the remuneration in a timely manner and to provide all detailed guidelines.

The Contractor declares that in order to carry out the contract, he will commission Editors of his choice to perform it.

As part of the execution of the order, the Ordering Party does not acquire proprietary copyrights to the study, nor does it obtain a license authorizing the dissemination of the study. The Ordering Party is entitled to use the study only for the purpose indicated in these Regulations.

§ 5 Complaints

After the Contractor prepares a written text on the commissioned subject, the Contractor sends it to the Employer. The Employer may, within 30 days from the date of receipt of the work, in writing or electronically, provide the Contractor with reservations as to the quality of the work in order for the Contractor to make one-off, free corrections. The parties agree that if the Ordering Party does not present any substantiated objections within the time limit specified in this paragraph, it is considered that the Contractor has performed the Services of appropriate quality and in full, and the Ordering Party has accepted them.

The basis for considering the complaint is the fact that the Contractor did not take into account the guidelines received from the Ordering Party, indicated in the Order Confirmation.

The Ordering Party is obliged to show in detail all reservations to the service performed by the Contractor in relation to the relevant paragraphs, chapters, and paragraphs that require editing and correction in accordance with the guidelines.

After the Contractor has made corrections based on the comments presented in the Awarding Entity’s reservations, the Contractor shall submit the corrected text. After submitting the corrected text, any other comments not previously submitted will be corrected by the Contractor for an additional fee at the cost of the Ordering Party.

If the comments on the quality of work contained in the re-reservations have not been specified in the first reservations, and the Ordering Party refuses to pay additional fees for making appropriate corrections to the text, it is considered that the Services were provided by the Contractor of an appropriate quality and are accepted by the Ordering Party.

If the Services are provided in parts / stages and the payment takes place after the completion of each stage, the fact of payment for a given stage means its acceptance by the Ordering Party. If the Ordering Party accepts the provided Services or their part, any further changes, corrections of the written work or the accepted part are made for a separate fee agreed upon by the Parties.

After the lapse of 30 days from the date of handing over the entire work or after payment by the Ordering Party for a particular stage of work – the Contractor has the right to refuse to make corrections or demand an additional fee for making corrections.

§ 6 Payment

The Contractor declares that the price for the performance of the service may be specified in the following currencies: Great British Pound (GBP), US dollar (USD), euro (EUR).

Depending on individual arrangements between the Contractor and the Ordering Party, the payment may be made once or in tranches, which will be indicated in the Order Confirmation.

The Contractor allows the following forms of payment in remuneration:

a) Payment by credit/debit card or Apple/Google Pay

b) Payment by wire transfer SWIFT/SEPA

c) Payment in the online payment system “Stripe”

In the event of delay in payment, the Contractor is entitled to charge statutory interest for the delay for each day of delay.

§ 7 Withdrawal from the contract

By concluding a distance contract, the contracting authority has the option to withdraw from the contract without giving any reason within 14 calendar days from the date of the contract. The declaration of withdrawal from the contract should be sent in electronic form to the Contractor’s e-mail: info@akademickeprace.cz

The template of the declaration of withdrawal from the Agreement is attached as Appendix 2 to the Regulations.

The Ordering Party acknowledges that he is not entitled to withdraw from the contract if the Contractor has already performed the service with the consumer’s consent.

§ 8 Force Majeure

The parties are released from liability for non-performance or improper performance of obligations under this Agreement, if they arose as a result of force majeure.

For the purposes of this Agreement, force majeure is considered to be all circumstances that could not have been foreseen or avoided, including: natural disasters (fire, earthquake, landslides, flood, storm or other atmospheric phenomena), pandemics, epidemics, wars, uprisings , revolts, strikes or decisions or normative acts of government authorities, regulation, restriction, prohibitions or other state interference, explosions and other damage to production and distribution devices, and nationwide failures of the Internet network.

A party to the contract that fails to meet or expects that it will not meet its obligations under the contract (taking into account all known facts) due to force majeure, should immediately inform the other party to the contract and make every effort to reverse such a state or its consequences. and their removal.

§ 9 Personal data protection

The administrator of personal data is: Academic Works LLP, a limited liability partnership, based in 411 Oxford Street, London, W1C 2PE, United Kingdom, company number OC443692.

The administrator processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR), tailored by the Data Protection Act 2018.

The data is processed only for the purpose of providing the service referred to in the Regulations.

Detailed information on the processing of personal data is set out in the “Privacy Policy” tab available on the Website, which is an integral part of these Regulations.

§ 10 Provision of services by electronic means

The Ordering Party may use the services via the Website, subject to the following technical conditions of the ICT system:

access to the Internet and an active e-mail account,

using browsers: ……………… in version …………………………… with up-to-date versions of Java and Flash installed,

on screens with a resolution of ……………………… px,

The use of third party software that affects the functioning and functionality of browsers or the use of mobile devices may affect the correct display of the Website.

The Ordering Party’s use of the Website by means of other means of distance communication is associated with the necessity to bear the connection costs. The above fees are not collected by the Contractor, but by the provider of publicly available telecommunications services within the meaning of the Communications Act 2003 (as amended by the Telecommunications (Security) Act 2021) , whose services are used by the Ordering Party. The cost of calls is charged according to the tariffs of the telecommunications operator.

The Ordering Party is prohibited from providing illegal content.

The Contractor takes steps to ensure the proper operation of the Website, to the extent that results from the current technical knowledge and undertakes to immediately remove defects or interruptions in its functioning.

The Contractor is not responsible for improper performance of the services in the event of technical problems beyond the Contractor’s control.

The Ordering Party should immediately notify the Contractor of any defects or interruptions in the functioning of the Website by submitting a complaint in writing to the Contractor’s address or via e-mail. The Contractor shall consider the complaint within 14 days from the date of its receipt, informing the Employer immediately about its results.

§ 11 Final provisions

These Regulations are valid from 02/03/2022.

The current Regulations are published on the Website in the “Regulations” tab.

The Contractor reserves the right to amend the Regulations in the event of:

organizational or legal changes at the Contractor,

changes in the applicable legal provisions applicable to these Regulations or changes in the practice of applying the law,

development of internet technologies and changes in the functionality of the Website, when the changes to the Regulations are aimed at adapting the content of the Regulations to this functionality,

changes to the rules of using the services or the Website

– with the proviso that orders placed before the entry into force of these changes will be implemented according to the current rules.

It does not constitute a change to the Regulations: a change in the contact details of the Contractor contained therein or a change in his data resulting from a change in the legal form of his business.

Detailed information on the possibility for the consumer to use extrajudicial means of redress and the rules of access to these procedures are available, inter alia, at the offices and on the websites of the Office of Competition and Consumers, poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection.

Any disputes arising under these Regulations or the Agreement, which the Parties fail to resolve in the first place amicably, are then subject to resolution by a common court competent for the seat of the Contractor, and in relation to Consumers, a common court competent in accordance with the general principles set out in the provisions of the The Civil Procedure Rules 1998.

The ordering party is fully responsible for providing all complete data for the execution of the order.

The Contractor reserves that the materials prepared and made available by the Contractor may only serve as inspiration for creating independent studies. They are of a model, auxiliary nature, just like any other scientific work available on the market, e.g. books. Therefore, they may only be used in accordance with the legal provisions. The Contractor does not consent to the presentation of studies prepared by the Contractor at universities as his own.

The person ordering the scientific material also declares that it will use it only in accordance with the law in force in the United Kingdom or any other countries where it is supposed to be used.

§ 1 Základní ustanovení

Academic Works LLP je společnost s omezeným ručením, která je zapsána v souladu s právními předpisy Anglie a Walesu pod identifikačním číslem OC443692 (dále jen „společnost“, „my“, „nám“ nebo „naše“). Sídlo společnosti se nachází na adrese 411 Oxford Street, Londýn, W1C 2PE, Spojené království (dále jen „Zhotovitel“). Tento statut stanovuje pravidla a podmínky, za kterých jsou uzavírány a realizovány smlouvy mezi Zhotovitelem a klientem, který vystupuje jako objednatel (dále jen „Objednatel“).

Tato pravidla zároveň stanoví všeobecné obchodní podmínky a upravují způsob poskytování služeb elektronickou cestou prostřednictvím webových stránek Zhotovitele, které jsou dostupné na adrese: akademickeprace.cz (dále jen „Webové stránky“).

Činnost Zhotovitele zahrnuje redakční a ediční služby v různých vědních oborech, stejně jako informační a poradenské služby. Zhotovitel se specializuje na poskytování služeb spojených s tvorbou vědeckých studií, které slouží výhradně jako vzor nebo výchozí materiál pro vlastní tvorbu Objednatele. Veškeré práce vytvořené Zhotovitelem jsou určeny pouze pro informační účely a jejich využití musí být v souladu s ustanoveními autorského zákona a zákona o autorských právech, vzorech a patentech z roku 1988.

Všechny výukové materiály, analýzy, vědecké studie nebo jiné texty jsou zpracovávány na základě individuální objednávky Objednatele a v souladu s jeho specifickými požadavky a pokyny. Zhotovitel tímto potvrzuje, že vytvořené materiály nejsou určeny k dalšímu prodeji a jsou výhradně k dispozici Objednateli.

Pokud tato Pravidla nestanovují konkrétní formu prohlášení a komunikace mezi stranami, je považována za přijatelnou komunikace prostřednictvím e-mailu.

Zadání objednávky Objednatelem se považuje za plné přijetí těchto Pravidel. Odmítnutí přijetí těchto Pravidel znamená nemožnost uzavření smlouvy s Objednatelem.

Informace uvedené na Webových stránkách nepředstavují nabídku ve smyslu občanského zákoníku.

Všechny objednávky jsou realizovány převážně ve španělštině a angličtině.

2 Vyřízení objednávky

Objednávku lze podat následujícími způsoby:

  1. zasláním e-mailu na adresu: info@akademickeprace.cz,
  2. vyplněním kontaktního formuláře dostupného na webových stránkách: akademickeprace.cz,
  3. telefonicky na čísle: +34 919 93 05 17.

Termín dokončení objednávky, stejně jako forma a datum platby, jsou individuálně dohodnuty mezi Zhotovitelem a Objednatelem.

Datum dokončení objednávky, které bylo dohodnuto mezi stranami, je považováno za předpokládané. Lhůta pro splnění objednávky může být prodloužena v případě okolností, které jsou mimo kontrolu Zhotovitele. Zhotovitel je povinen informovat Objednatele o prodloužení data dokončení objednávky.

Materiál je zpracován na základě dostupných knižních materiálů a internetových zdrojů, včetně těch, které uvedl Objednatel.

Objednávka se zpracovává následujícím způsobem:
Objednatel zadá objednávku jedním ze tří kanálů uvedených v bodě 1 tohoto odstavce. V objednávce Objednatel uvede pokyny týkající se objednávky.

Do 48 hodin od odeslání objednávky Zhotovitel ověří možnost provedení objednané služby a informuje o tom Objednatele zasláním Potvrzení objednávky, které tvoří Přílohu č. 1 Pravidel. Potvrzení objednávky obsahuje podstatné náležitosti smlouvy, včetně předmětu služby, data poskytnutí služby, ceny služby, způsobu platby, jakož i pokynů Objednatele k plnění smlouvy, pokud Objednatel tyto pokyny v objednávce uvedl.

Do 24 hodin od obdržení Potvrzení objednávky od Zhotovitele by měl Objednatel e-mailem akceptovat jeho obsah. Přijetí Potvrzení objednávky se považuje za souhlas s těmito Podmínkami.

Po přijetí Potvrzení objednávky uhradí Objednatel odměnu nebo její první tranši v souladu s ujednáními uvedenými v Potvrzení objednávky. Smlouva je mezi stranami uzavřena dnem platby.

Po obdržení odměny nebo její první tranše zahájí Zhotovitel poskytování služby. Objednatel bere na vědomí, že v případě prodlení s platbou v dohodnuté lhůtě bude termín dokončení objednávky uvedený v Potvrzení objednávky odložen.

Pokud je služba prováděna po etapách, další etapa realizace služby následuje s každou další etapou platby. Po obdržení 1. (první) části práce provede Zhotovitel opravy dle požadavků Objednatele.

Je-li služba poskytnuta jednorázově, zašle Zhotovitel Objednateli celou studii.

Objednatel je povinen podrobně uvést pokyny pro zadávání zakázky. Nedodržení této formality znamená, že reklamace týkající se objednávky nebudou vyřízeny.

Zhotovitel si vyhrazuje, že pro něj jsou závazné pouze pokyny uvedené v Potvrzení objednávky. Objednatel má právo na bezplatné opravy, pokud pokyny nebudou dodrženy.

3 Pravidla pro používání vědeckých materiálů

Materiály připravené a zpřístupněné Zhotovitelem mohou sloužit pouze jako inspirace pro tvorbu samostatných studií, protože jsou pouze příkladné a pomocné.

Objednatel prohlašuje, že tyto materiály bude používat pouze v souladu s platnými právními předpisy ve Spojeném království nebo v jiných zemích, kde mají být použity.

Studie připravené Zhotovitelem nebo fragmenty těchto studií nesmí být Objednatelem prezentovány na univerzitách jako vlastní, jelikož se jedná o nezákonnou činnost. Zhotovitel nesouhlasí s tím, aby Objednatel prezentoval připravené studie třetím stranám, univerzitám a institucím jako vlastní díla Objednatele.

V případě porušení ustanovení těchto předpisů Objednatelem a obvinění z nezákonného použití zveřejněných studií si Zhotovitel vyhrazuje právo okamžitě ukončit spolupráci s Objednatelem, a to bez povinnosti vrátit dosud zaplacenou odměnu.

Zhotovitel nenese odpovědnost za nesprávné nebo nezákonné použití poskytnutých materiálů.

4 Práva a povinnosti Zhotovitele a Objednatele

Objednatel je povinen včas uhradit odměnu a poskytnout veškeré podrobné pokyny nezbytné pro řádné plnění zakázky.

Zhotovitel prohlašuje, že za účelem plnění smlouvy pověří jejím provedením redaktory dle vlastního výběru.

V rámci plnění zakázky nezískává Objednatel vlastnická autorská práva ke studii ani licenci opravňující k šíření studie.

Objednatel je oprávněn studii použít pouze k účelu uvedenému v těchto pravidlech.

5 Reklamace

Poté, co Zhotovitel vypracuje písemný text k zadanému předmětu, zašle jej Objednateli.

Objednatel může do 30 dnů od data převzetí díla písemně nebo elektronicky vznést Zhotoviteli výhrady ke kvalitě díla, aby Zhotovitel mohl provést jednorázové a bezplatné opravy.

Strany se dohodly, že pokud Objednatel nevznese žádné odůvodněné námitky ve lhůtě uvedené v tomto odstavci, má se za to, že Zhotovitel provedl Služby v odpovídající kvalitě a v plném rozsahu a Objednatel je akceptoval.

Důvodem pro posouzení reklamace je skutečnost, že Zhotovitel nezohlednil pokyny obdržené od Objednatele, uvedené v Potvrzení objednávky.

Objednatel je povinen podrobně uvést všechny výhrady ke službě poskytnuté Zhotovitelem ve vztahu k příslušným odstavcům, kapitolám a paragrafům, které vyžadují úpravu a opravu v souladu s pokyny.

Poté, co Zhotovitel provede opravy na základě připomínek uvedených ve výhradách Objednatele, předloží Zhotovitel opravený text.

Po předložení opraveného textu Zhotovitel za příplatek na náklady Objednatele opraví veškeré další připomínky, které nebyly dříve předloženy.

Pokud připomínky ke kvalitě práce obsažené v opětovných výhradách nebyly v prvních výhradách specifikovány a Objednatel odmítne uhradit dodatečné poplatky za provedení příslušných oprav textu, má se za to, že Služby byly Zhotovitelem poskytnuty v odpovídající kvalitě a Objednatel je akceptoval.

Jsou-li Služby poskytovány po částech/etapích a platba probíhá po dokončení každé etapy, znamená skutečnost platby za danou etapu její akceptaci Objednatelem. Pokud Objednatel přijme poskytnuté Služby nebo jejich část, jakékoli další změny, opravy písemné práce nebo akceptované části se provádějí za samostatný poplatek dohodnutý Stranami.

Po uplynutí 30 dnů ode dne předání celé práce nebo po zaplacení Objednatelem za konkrétní etapu práce má Zhotovitel právo odmítnout provedení oprav nebo požadovat dodatečný poplatek za provedení oprav.

6 Platba

Zhotovitel prohlašuje, že cena za provedení služby může být stanovena v následujících měnách: Velká britská libra (GBP), americký dolar (USD), euro (EUR).

V závislosti na individuálních dohodách mezi Zhotovitelem a Objednatelem může být platba provedena jednorázově nebo v tranších, které budou uvedeny v Potvrzení objednávky.

Zhotovitel umožňuje následující formy platby odměny:
a) Platba kreditní/debetní kartou nebo Apple/Google Pay
b) Platba bankovním převodem SWIFT/SEPA
c) Platba v online platebním systému «Stripe»

V případě prodlení s platbou je Zhotovitel oprávněn účtovat zákonný úrok z prodlení za každý den prodlení.

7 Odstoupení od smlouvy

Uzavřením smlouvy uzavřené na dálku má Objednatel možnost od smlouvy odstoupit bez udání důvodu do 14 kalendářních dnů ode dne uzavření smlouvy.

Prohlášení o odstoupení od smlouvy by mělo být zasláno v elektronické podobě na e-mailovou adresu Zhotovitele: info@akademickeprace.cz.

Vzor prohlášení o odstoupení od smlouvy je přiložen jako příloha č. 2 k obchodním podmínkám.

Objednatel bere na vědomí, že není oprávněn odstoupit od smlouvy, pokud Zhotovitel již službu poskytl se souhlasem Objednatele.

8 Vyšší moc

Smluvní strany jsou zproštěny odpovědnosti za neplnění nebo nesprávné plnění povinností vyplývajících z této Smlouvy, pokud vznikly v důsledku vyšší moci.

Pro účely této Smlouvy se za vyšší moc považují veškeré okolnosti, které nebylo možné předvídat ani jim zabránit, včetně:

  • přírodních katastrof (požár, zemětřesení, sesuvy půdy, povodně, bouře nebo jiné atmosférické jevy),
  • pandemií, epidemií,
  • válek, povstání, revolt, stávek,
  • rozhodnutí či normativních aktů státních orgánů, regulací, omezení, zákazů nebo jiných státních zásahů,
  • výbuchů a jiných poškození výrobních a distribučních zařízení,
  • celostátních výpadků internetové sítě.

Smluvní strana, která neplní nebo očekává, že nesplní své povinnosti vyplývající ze Smlouvy (s přihlédnutím ke všem známým skutečnostem) v důsledku vyšší moci, by měla neprodleně informovat druhou smluvní stranu.

Smluvní strana zasažená vyšší mocí je povinna vynaložit veškeré úsilí k zvrácení takového stavu nebo jeho následků a jejich odstranění.

9 Ochrana osobních údajů

Správcem osobních údajů je: Academic Works LLP, společnost s ručením omezeným, se sídlem 411 Oxford Street, Londýn, W1C 2PE, Spojené království, IČO OC443692.

Správce zpracovává osobní údaje v souladu s obecným nařízením o ochraně osobních údajů Spojeného království (UK GDPR), upraveným zákonem o ochraně osobních údajů z roku 2018.

Osobní údaje jsou zpracovávány pouze za účelem poskytování služby uvedené v těchto zařízeních.

Podrobné informace o zpracování osobních údajů jsou uvedeny v záložce „Zásady ochrany osobních údajů“ dostupné na webových stránkách, která je nedílnou součástí těchto nařízení.

10 Poskytování služeb elektronickými prostředky

Objednatel může využívat služby prostřednictvím Webových stránek za následujících technických podmínek ICT systému:

  • přístup k internetu a aktivní e-mailový účet,
  • používání prohlížečů: …………………… ve verzi ……………………………… s nainstalovanými aktuálními verzemi Javy a Flashe,
  • na obrazovkách s rozlišením ………………………… px.

Použití softwaru třetích stran, který ovlivňuje fungování a funkčnost prohlížečů, nebo používání mobilních zařízení může ovlivnit správné zobrazení Webových stránek.

Používání Webových stránek Objednatelem prostřednictvím jiných prostředků komunikace na dálku je spojeno s nutností nést náklady na připojení. Výše uvedené poplatky nevybírá Zhotovitel, ale poskytovatel veřejně dostupných telekomunikačních služeb ve smyslu zákona o komunikacích z roku 2003 (ve znění zákona o telekomunikacích (bezpečnost) z roku 2021), jehož služby Objednatel využívá. Cena hovorů je účtována dle tarifů telekomunikačního operátora.

Objednateli je zakázáno poskytovat nelegální obsah.

Zhotovitel podniká kroky k zajištění řádného provozu Webových stránek v rozsahu, který vyplývá z aktuálních technických znalostí, a zavazuje se neprodleně odstranit závady nebo přerušení jejich fungování.

Zhotovitel nenese odpovědnost za nesprávné provedení služeb v případě technických problémů mimo kontrolu Zhotovitele.

Objednatel by měl neprodleně informovat Zhotovitele o jakýchkoli vadách nebo přerušeních fungování Webových stránek písemnou reklamací na adresu Zhotovitele nebo e-mailem. Zhotovitel reklamaci posoudí do 14 dnů ode dne jejího obdržení a o jejím výsledku neprodleně informuje Objednatele.

11 Závěrečná ustanovení

Tyto Pravidla jsou platná od 02.03.2022.

Aktuální Pravidla jsou zveřejněna na Webových stránkách v záložce „Pravidla“.

Zhotovitel si vyhrazuje právo změnit Pravidla v případě:

  • organizačních nebo právních změn u Zhotovitele,
  • změn platných právních ustanovení vztahujících se na tato Pravidla nebo změn v praxi jejich uplatňování,
  • rozvoje internetových technologií a změn ve funkcionalitě Webových stránek, pokud jsou cílem změn Pravidel přizpůsobení obsahu Pravidel této funkcionalitě,
  • změn pravidel používání služeb nebo Webových stránek,
    – s podmínkou, že objednávky podané před nabytím účinnosti těchto změn budou realizovány podle aktuálních pravidel.

Za změnu Pravidel se nepovažuje:

  • změna kontaktních údajů Zhotovitele v nich uvedených,
  • změna jeho údajů vyplývající ze změny právní formy jeho podnikání.

Podrobné informace o možnosti spotřebitele využít mimosoudní prostředky nápravy a pravidlech přístupu k těmto postupům jsou k dispozici mimo jiné v kancelářích a na webových stránkách Úřadu pro hospodářskou soutěž a spotřebitele, okresních (městských) ombudsmanů spotřebitelů a společenských organizací, jejichž zákonné úkoly zahrnují ochranu spotřebitele.

Veškeré spory vzniklé na základě těchto předpisů nebo Smlouvy, které se stranám nepodaří nejprve vyřešit smírnou cestou, podléhají řešení:

  • obecného soudu příslušného v místě sídla Zhotovitele,
  • ve vztahu ke spotřebitelům obecnému soudu příslušnému v souladu s obecnými zásadami stanovenými v ustanoveních občanského soudního řádu z roku 1998.

    Zhotovitel si vyhrazuje, že materiály připravené a zpřístupněné Zhotovitelem mohou sloužit pouze jako inspirace pro tvorbu samostatných studií. Tyto materiály mají vzorový a pomocný charakter, podobně jako jiné vědecké práce dostupné na trhu, např. knihy. Proto mohou být použity pouze v souladu se zákonnými ustanoveními.

Zhotovitel nesouhlasí s prezentací studií vypracovaných Zhotovitelem na univerzitách jako vlastních prací Objednatele.
